About these terms

These terms of service are an agreement between you and Spillch ("Spillch", "we" or "us"), the operator named on our About page. They apply whenever you use the Spillch website or app (the "service").

By creating an account or using the service, you agree to these terms, our privacy policy and our content policy. If you don't agree, please don't use Spillch.

Eligibility and your account

You must be at least 18 years old to use Spillch. By signing up, you confirm that you are.

You are responsible for your account and for keeping your sign-in details secure. If you think someone else has access to your account, tell us at the email on our Contact page.

Each person may have only one account. Don't create or use other accounts to get around allowances, a suspension or a ban.

We may ask you to verify your email address before you can continue chatting.

AI characters

Every character on Spillch is an artificial intelligence. Characters are fictional and don't represent real people. Their replies are generated automatically, may be inaccurate, inconsistent or inappropriate, and are not the views of Spillch.

Characters are not doctors, lawyers, financial advisers, therapists or any other kind of professional, so don't rely on them for advice. If you are in distress, contact Tele-MANAS on 14416 (free, 24/7), or call 112 in an emergency.

Your content

You keep ownership of what you write and of the characters you create ("your content"). You give Spillch a non-exclusive, royalty-free licence to store, process and display your content as needed to run the service, including sending it to the providers named in our privacy policy to generate replies and pictures and to check content for safety. If you publish a character, this licence also lets us show it to other users until you unpublish or delete it.

You are responsible for your content. It must follow our content policy, and it must not infringe anyone else's rights or use a real person's identity without their consent.

Replies and pictures generated for you are provided for your personal, non-commercial use.

Acceptable use

Use Spillch only as allowed by law, these terms and our content policy. In particular, don't: try to obtain sexually explicit content, or any sexual content involving minors; harass, threaten or exploit anyone; try to extract the hidden instructions or personalities behind characters; scrape, automate or overload the service, or access it other than through our website and app; interfere with security features, allowances or rate limits; or resell the service or use it commercially.

Plans, allowances and limits

Spillch is free to use within the Free plan's allowances. Paid plans (Plus monthly, Plus annual and the Weekly Pass) give larger allowances. Current plans and prices are on our Pricing page.

Allowances are measured per 5-hour session and per week (each week starts on Monday at 00:00 IST), and depend on how much text your chats use rather than on a fixed number of messages. Everyone is also limited to 10 messages a minute. We may change allowances and limits; the values shown in the app at the time always apply.

To keep the service available, free chats may pause until 00:00 IST when free usage reaches its capacity for the day. Paid plans are not affected.

Payments and subscriptions

Payments are processed by Razorpay, in Indian rupees. Any applicable taxes are shown before you pay. A plan or purchase is applied to your account only after the payment is confirmed.

Plus monthly renews automatically each month, by UPI AutoPay or card, until you cancel. You can cancel at any time from Account → Plan, and Plus stays active until the end of the period you've paid for. If a renewal payment fails, you keep Plus for a 3-day grace period while the payment is retried.

Plus annual, the Weekly Pass and SpillCoin packs are one-time purchases. They don't renew.

Refunds are covered by our cancellation and refund policy. If a payment is refunded or reversed, for example through a chargeback, what it paid for is withdrawn. While a payment dispute is open, you may not be able to make new purchases or spend SpillCoins.

Deleting your account stops any subscription from renewing, but doesn't by itself entitle you to a refund.

SpillCoins

SpillCoins are a virtual credit for generating pictures on Spillch. They have no cash value, can't be exchanged for money, transferred or sold, and can be used only on the account that bought them.

SpillCoins don't expire while your account is open. If a picture can't be generated, or is blocked by our safety checks, its SpillCoins go back to your balance. Unspent SpillCoins are lost when you delete your account.

Suspension and termination

You can stop using Spillch at any time, and delete your account from Account → Privacy → Delete your account.

We may restrict, suspend or close your account, or remove your content, if you break these terms or our content policy, if the law requires it, or to protect our users or the service. Where appropriate, we'll tell you why. If you think we've made a mistake, email the email on our Contact page.

Changes to the service and these terms

Spillch keeps evolving: we may add, change or remove features, characters, plans and prices. A price change never affects a period you've already paid for.

We may update these terms. Before a significant change takes effect, we'll tell you in the app or by email, and we may ask you to accept the new terms to keep using the service. The date at the top of this page shows when they last changed.

Disclaimers and liability

Spillch is provided "as is" and "as available". To the extent permitted by law, we don't promise that the service will be uninterrupted or error-free, or that replies will be accurate or suitable for any purpose.

To the extent permitted by law, Spillch is not liable for indirect, incidental or consequential loss, or for loss of data, profits or goodwill, and our total liability to you for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits any liability that can't be limited under applicable law, or your rights as a consumer.

Governing law and disputes

These terms are governed by the laws of India. If you have a problem with Spillch, please contact us first at the email on our Contact page so we can try to resolve it. Subject to that, the courts of India have jurisdiction over any dispute relating to these terms or the service.
